Pickle and Podge Limited Terms and Conditions of Sale (“General Ts & Cs”)

DEFINITIONS

Throughout these General Ts and Cs any reference to :- (i) “the website”, means www.pickleandpodge.co.uk, which is operated by Pickle and Podge Limited ("P&P"), (ii)"we", "us" and "our" means P&P, (iii) "you" and "your", means any person placing an order via the website, (iv) “items” or “products”, means an item, product or merchandise we offer for sale on the website (v) “goods”, means an item which we agree to sell to you following an order placed by you on the website and (vi) “Delivery Pages” and “Returns Pages”, mean those pages (as amended from time to time) on the website specifically dealing with delivery and return respectively of the products. Any term defined in this section, when used in the Delivery Pages and/or the Returns Pages, has the same meaning as in the General Ts and Cs.
We may update and/or amend the General Ts & Cs, the Delivery Pages and/or Returns Pages at any time.

PLACING AN ORDER

You must be eighteen years old or older to use the website. If you are under eighteen, you may only use the website with the agreement of, and under the supervision of, a parent or guardian. If you do not qualify, please do not use the website. You warrant: that you fully comply with the above requirements, that all details you provide to P&P for the purpose of ordering or purchasing goods are true, accurate, current and complete in all respects, that the payment card you are using is your own and that there are sufficient funds in your account to cover payment of the product(s) ordered.

By placing an order via this website, you are making an offer to P&P to purchase the goods. By placing an order with us you will be deemed to have read, understood and agreed to these General Ts & Cs. If you are unhappy with or unclear about any aspect of these terms, please contact one of our customer service advisors before placing an order with us by email at info@pickleandpodge.co.uk or by mail using the address given below.

Once you have placed an order, we will send you a confirmation that your order has been received, but this is not a confirmation that your offer to purchase the goods has been accepted. A contract between you and P&P for the sale of products will only exist once an order has been accepted, processed and dispatched to you by us. Your payment card account will be authorised when your order is placed and processed, but you will not be charged for the value of the goods until the point that they are dispatched to you. This does not affect your statutory rights.

Prices and availability of goods are subject to change without notice. A delivery charge will be added to your order value where appropriate.

All dates quoted for delivery; - (i) are for delivery to your nominated delivery address, (ii) are estimated delivery dates only and (iii) may be subject to change. We may, at any time, change the nominated store for collection under our Click and Collect service. We can accept no liability for any loss or damage (whether direct or indirect) if delivery takes place at any time other than the estimated date for delivery. CONFORMITY OF GOODS

We take all reasonable care to ensure that the description and specification of our products are correct at the time they are loaded on the website. However, specifications and descriptions of products on the website are not intended to be binding and are intended only to give a general description of the products. Furthermore, while the colour reproduction of the products is intended to be a close representation, we cannot accept any responsibility for any variation in colour, including any variation caused by the browser software or computer system used to view the products.

STOCK AVAILABILITY

We endeavour to display through the website all items in our current range. We aim to hold stock of all styles and sizes whilst a product is active. However, occasionally an item(s) will be out of stock and if this is the case we will endeavour to highlight this on the website.

Our items available for sale will change on a frequent basis. We reserve the right to make changes in our range of items without notice. An item may be out of stock temporarily or permanently or may be discontinued from our product line. When an item is no longer available, we will endeavour to take reasonable steps to remove it from the website as soon as we can. If you cannot find an item you saw on a previous visit, please notify our Customer Service team and we will let you know whether we can find the item for you. If we do not have stock to deliver the goods our Customer Service team will contact you. We will not charge your credit or debit card until your order is in stock and ready to be shipped.

RETURNS POLICY

If you are not entirely delighted with any product that you have chosen you may return it to us within 30 days of receipt. We will be happy to offer you a refund or replacement provided that the product has been returned complete, in perfect condition, unused, unwashed and with the original packaging intact, Items can be returned outside this period if they are accepted by us as faulty, but please take extra care to read and follow precisely any specific care instructions provided with your purchase. We cannot accept an item returned as being faulty if; - (i) the appropriate product care instructions have not been followed or (ii) any damage caused to the product is due to wear and tear or misuse or (iii) the product has not been returned to us within twelve months of it being dispatched to you. PRICES

All prices quoted on the website are accurate at the time of publication, are quoted in GBP Sterling, and, if VAT is chargeable, are inclusive of VAT. The price of any item is not guaranteed until the item has been shipped to you.

SALES TAX AND CUSTOMERS FEES

If your order is being dispatched to a destination outside the United Kingdom, you may be liable to pay local sales tax and/or import duties on arrival, however you may also be given the option to prepay these at checkout. You will be responsible for the payment of any customs or import duties levied against orders sent outside of the United Kingdom.

If you are purchasing outside of the United Kingdom, you may be liable to pay transaction fees to your card provider. You will be responsible for any card payment fees levied by your card provider. Please check with your card provider for details before placing your order.

DISCLAIMER & LIMITATIONS OF LIABILITY

P&P does not seek to exclude or limit liability for death or personal injury arising from its negligence or that of its, agents, directors or employees or for any fraudulent misrepresentation. To the fullest extent permitted by law and save as provided above, P&P shall not be liable to you by reason of any representation, or any implied warranty, condition or other term, or any duty at common law, or under the express terms of the contract, or in negligence (whether on the part of P&P or any of its members, agents, directors, employees or otherwise) for any indirect, special or consequential loss or damage (including but not limited to loss of profit or loss of saving), costs, expenses or other claims for compensation whatsoever which arise out of or in connection with the use of the website, the supply of the goods or their use or resale by you.

While P&P uses reasonable endeavours to ensure that the information on the website is accurate and up to date, it does not give any warranty or representation as to its accuracy or completeness and P&P will not be responsible for any errors or omissions or for the results arising from the use of such information. While P&P takes all reasonable steps to ensure a fast and reliable service, it does not guarantee that your use of the website will be interruption or error free and will not be responsible for any disruption, loss of or corruption of any material in transit, or loss of or corruption of material or data when downloaded onto any computer system.

Further, P&P will not be responsible nor liable for your use of any other websites which you may access via links within the website. P&P does not control these websites and is not responsible for their content. Any such links are provided merely as a service to users of the website and their inclusion on the website does not constitute an endorsement by or affiliation with P&P.

The entire liability of P&P under or in connection with any contract for any goods shall not exceed the price of the goods, except as expressly provided in these conditions.

P&P will not be liable to you or be deemed to be in breach of these terms and conditions or any other contract with you by reason of any delay in performing, or any failure to perform, any of its obligations in relation to the goods if the delay or failure was due to any cause beyond its reasonable control.

P&P may assign or transfer any of its rights or subcontract any of its obligations relating to any products or otherwise under these terms and conditions to any third party. You may not assign or transfer any of your rights or subcontract any of your obligations relating to the products or under these terms and conditions except with the specific permission in writing of P&P.

No person who is not a party to these terms and conditions shall have any right to enforce any term under the Contracts (Rights of Third Parties) Act 1999.

Nothing in these conditions is intended nor shall affect any of your statutory rights that may not be legally excluded.

The contents of the website and of these pages (including pictures, designs, logos, photographs, text written and other materials) are the copyright and may contain elements covered by trademark or registered trademark, of P&P or its content and technology providers or their respective owners. ALL RIGHTS ARE RESERVED. The copying, modification, distribution, reproduction, or incorporation into any other work of part, or all, of the material available on the website and/or these pages in any form is prohibited save that you may:

Copy, print (one copy only) or download extracts of the material on the website for the sole purpose of using the website in good faith for placing an order with P&P; and

Copy print (one copy only) or download the material on the website for the purpose of sending to individual third parties for their personal information in connection with that third party placing an order with us, provided that you seek no commercial advantage or benefit from so doing and you acknowledge us as the source of the material and that you inform the third party that these conditions apply to them and that they must comply with them.

PROMOTION CODES

No discount code or promotion we may provide or make, in any form, can be used in conjunction with any other offer we may make. During our sales promotions our products are already discounted, so your promotion or shopping code will not be valid when purchasing sale items. Every promotion or offer of discount we make: (i) relates to full priced items only and (ii) is subject there being availability of the item in stock.

EMAILS

Email offers (“E-Offers”) can only be used by you (i) if received in an email sent to you from P&P and (ii) to purchase goods from the website. Only one E-Offer can be used against each item purchased. All orders pursuant to E-Offers must be placed by the date quoted in the email. Every E-Offer we make: (i) relates to full priced items only (ii) is subject to there being availability of the item in stock and (iii) is subject to the specific terms of that offer as set out on the website (e.g. you will not be permitted to use more than one introductory offer we may make). No E- Offer can be used in conjunction with any other offer or discount we may make or offer.

LAW AND TERRITORY

These Terms and Conditions and your use of the website are governed by English law, and you agree to submit to the non-exclusive jurisdiction of the English court. This does not affect your non-excludable statutory rights. The website and the General Ts&Cs have been designed for use within the United Kingdom and under UK law. Whilst we are happy to consider requests for products and enquiries from outside the United Kingdom, we give no warranty, express or implied, that the use of the website or the placing of any order through the website from outside the UK complies with any applicable non-UK laws or regulations. Accordingly, any products or promotions not permitted under your local law are not offered to you.

GIFT CARD TERMS & CONDITIONS (UK ONLY)

The following terms & conditions (“GC Ts & Cs”) in addition to the General Ts & Cs apply to every electronic gift card which you may purchase from us through the website (“E-Gift Card”). The terms and conditions do not affect your statutory rights.

1.E-Gift Cards can be purchased online at the website for UK customers only.

2. E-Gift Cards can be purchased with a minimum value of £10 and have a maximum value limit of £200.

3. Promotion codes, discounts and offers cannot be used to purchase Gift Cards, unless expressly so indicated.

4. E-Gift Cards are redeemable online at the website. They are not valid for use in other stockists of P&P. At certain times exclusions may apply where an E-Gift Card cannot be used to make a particular purchase. P&P reserves the right to amend these exclusions at any time.

5. A maximum of 5 Gift Cards can be used as payment for each purchase online.

6. E-cards will be emailed to the recipient address provided to us when the order is placed.

7. When you use your E-Gift Card, the amount of your purchase will be deducted from the balance of the card. Change will not be given. Any balance on a E-Gift Card can be used as full or part payment on a future purchase. Any balance remaining will be shown in £ GBP.

8. E-Gift Cards cannot be used to purchase another E-Gift Card.

9. E-Gift Cards cannot be exchanged or redeemed for cash, and refunds will not be given for the purchase of an E-Gift Card. Refunds of items purchased with a E-Gift Card are subject to the P&P Returns Policy, as set out in the General Ts &Cs and our Returns Pages. This does not affect your statutory rights.

10. E-Gift Cards are valid for 24 months from the date of purchase. Any remaining balance left on the E-Gift Card after the expiry of the validity period will be cancelled and the E-Gift Card will become invalid and no longer available for use.

12. P&P cannot be held responsible for the unauthorised use of your E-Gift Card, including where the E-Gift Card code has become known to another party.

13. P&P reserves the right to update and change the GC T & Cs at any time. Purchase or use of an E-Gift Card constitutes acceptance of the GC Ts & Cs and the General Ts & Cs. Your E-Gift Card is the property of P&P who reserves the right to cancel the E-Gift Card in situations where it is deemed necessary.

14. These conditions are governed by and construed in accordance with the laws of England and Wales. You agree, as we do, to submit to the exclusive jurisdiction of the English courts.

16. E-Gift Cards are normally sent within two hours of completion of the normal fraud checks. If for any reason your E-Gift Card does not arrive please contact our customer care team on info@pickleandpodge.co.uk.
